1. Scope of application.
All product contracts and purchases will be made according to these conditions. These general conditions of purchase will be applicable to all future operations without the need for a new express agreement.
By placing an order, the customer agrees to be fully bound by the sales contract, set out in these conditions, with Skaapherder. Skaapherder offers the commercialization of its products in the European Union. However, if a user is interested in receiving an article outside the territory of the European Union, they should contact Skaapherder through the contact forms available on the website itself or by sending an email to info@skaapherder.com, in which case your request would be studied and you would be informed thereon.
Regarding the application of taxes in international transactions:
- When the buyer is another company or entrepreneur and his tax address is in Spanish territory, the sale is subject to VAT. If the company or entrepreneur does not reside in Spain, but does reside in the European Union, the sale is not subject to VAT as long as the buyer is registered as an intra-community operator and has a valid VAT number. Otherwise, it would be subject to VAT. If said company or entrepreneur resides in a country outside the European Union, the sale will not be subject to VAT since it is an export and the recipient company will settle the VAT in Customs.
- When the buyer is the final consumer: when the final consumer resides in Spain, the sale is subject to VAT. When the buyer does not reside in Spain, but does reside within the European Union, the sale is subject to VAT in accordance with the general rule of taxation in the country of origin (Spain).
- United Kingdom: Until December 31, 2020 it will be treated as a country of the European Union. As of January 1, 2021, it will be treated as a country outside the European Union, so it will be considered an export and the transaction will be exempt from VAT.
Skaapherder may periodically modify these General Purchase Conditions, whose latest version may be consulted at any time on this website.
2. Communication with the client.
When placing the order, the customer must indicate their personal data, shipping and billing address, email and select the payment method. The operability of the email address must be ensured from the moment the order is placed until it is received. In particular, the customer must verify the settings of his spam filter (locally and / or by his mail provider) and check that he receives the email from Skaapherder, in case he could have received it there. This indicated email address can be applied in future orders as long as the client does not modify it or request its change or rectification.
Skaapherder messages sent by email to the indicated email address will be assumed to have been received by the customer after being sent. Skaapherder is only responsible for possible transmission errors if they are based on its own scope, without prejudice to the option of the client to provide evidence of not having received the message for reasons beyond his control.
Skaapherder is not obliged to notify the client of errors, faults or ineffectiveness of the email account, without prejudice to the option of the client to provide evidence in this regard.
3. Purchase.
To place an order, the customer will have to access the website www.skaapherder.com, select the garments and sizes that they wish to buy and add the chosen products to the basket (shopping cart).
To continue with the buying and selling process, the customer will have to fill in the order form, entering its personal data, the shipping and billing address, its email and the chosen payment method, finally validating it. Skaapherder will send the buyer an email proof of purchase as soon as possible. Remember that when placing an order, the customer should check its SPAM or spam folder in case, eventually, you have received the email from Skaapherder in that folder.
Likewise, the customer must verify that the billing and shipping information are correct. The time to make specifications on the product and other details that the customer wants, it will be during the order. In the event that the client does not specify their customizations at that moment, Skaapherder will choose the details by default, without any subsequent option of rejection by the buyer. Without having any obligation in this regard, Skaapherder may, in cases where it can detect an error, contact the client to request the appropriate correction. In these cases, the delivery period will be suspended until the customer responds by providing the correct data. However, if 60 days have elapsed from the request for the data without the buyer replying, the shipment will be understood to be canceled without the buyer being reimbursed the price.
The validation of the order by the customer implies the knowledge and express acceptance of the general contracting conditions. Unless proven otherwise, the data recorded by Skaapherder constitute proof of all the transactions carried out with its customers. Skaapherder will archive the electronic document in which the contract is formalized and it will be accessible.
If you have any questions during the purchase process, you can contact Skaapherder by sending an email to info@skaapherder.com.
